Agreement to Terms

By accessing or using ExamTeX, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

Description of Service

ExamTeX is an AI-powered study platform that turns your course materials into professional, LaTeX-formatted exams, flashcards, and study podcasts. Users can upload documents, record or import lecture audio, configure study materials, and download publication-quality PDFs.

User Accounts

To use certain features of ExamTeX, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update this information as needed.

Acceptable Use

You agree to use ExamTeX only for lawful purposes and in accordance with these Terms. You agree not to:

- Upload content that infringes on intellectual property rights
- Use the service to create fraudulent academic materials
- Attempt to reverse engineer or extract our AI models
- Share your account credentials with others
- Use automated systems to access the service without permission
- Interfere with the proper functioning of the service

Recording Lectures & Third-Party Consent

ExamTeX lets you record or upload lecture and other audio to turn it into transcripts, flashcards, and exams. Recording other people can be regulated by law, and by the policies of your school, university, or workplace.

Certain jurisdictions require the consent of every person being recorded, and certain organizations and educational institutions prohibit recording live lectures without the consent of the professor, lecturer, and/or other attendees. Certain courses and instructors may have their own recording policies that you are required to follow.

You are solely responsible for reviewing all applicable laws and policies and for ensuring that you comply with them and have obtained all consents necessary before creating or uploading any recording. You must not record or upload any material that contravenes the policies set by your school, college, workplace, university, or instructor, or the law of any jurisdiction that applies to you. You may not use ExamTeX to record any person without any consent required by law.

To respect the intellectual property of educators and the privacy of the classroom, ExamTeX does not allow you to share recordings or verbatim transcripts with other users through the service.

Your Representations and Warranties

You represent and warrant that all inputs, content, data, prompts, files, recordings, and other materials you upload, submit, transmit, or otherwise provide to or through ExamTeX, and our processing of them as permitted by these Terms:

- Are lawful and do not violate any applicable law, regulation, or institutional policy;
- Do not infringe, misappropriate, or violate any confidentiality, intellectual property, privacy, publicity, contractual, or other rights of any person; and
- Are provided with all necessary notices and with all rights, licenses, consents, and permissions required from any third party, including the consent of any person captured in a recording.

Fair Use & Service Integrity

ExamTeX is designed for individual educators and students creating exams for legitimate academic purposes. To ensure a reliable experience for all users, we reserve the right to monitor usage patterns and take action against activity that we reasonably determine to be abusive, excessive, or inconsistent with normal use of the service.

Examples of prohibited activity include, but are not limited to:

- Generating exams at a volume or frequency that places undue strain on our infrastructure
- Using the service for commercial resale, redistribution, or bulk content generation
- Operating multiple accounts to circumvent usage policies
- Accessing the service through automated scripts, bots, or scrapers without prior written consent

If we detect activity that violates this policy, we may, at our sole discretion, throttle, suspend, or terminate your access to the service without prior notice. We may also pursue any legal remedies available to us.

Intellectual Property

Your Content: You retain all rights to the materials you upload and the exams you create. By uploading content, you grant us a limited license to process it for the purpose of generating your exams.

Our Service: ExamTeX, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our service without permission.

AI-Generated Content

Exams generated by ExamTeX are created using artificial intelligence. While we strive for accuracy, you are responsible for reviewing and verifying all generated content before use. We recommend checking:

- Mathematical accuracy of equations and solutions
- Appropriateness of questions for your course level
- Correctness of answer keys
- Overall suitability for your educational context

Disclaimer of Warranties

ExamTeX is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that generated content will be free of errors.

We are not responsible for any academic or professional consequences arising from the use of AI-generated exam content.

Limitation of Liability

To the maximum extent permitted by law, ExamTeX and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Indemnification

You agree to indemnify, defend, and hold harmless ExamTeX and its operators from and against all losses, claims, liabilities, demands, damages, judgments, settlements, fines, penalties, expenses, and costs (including reasonable attorneys' fees) that arise out of or in connection with: (a) your violation of any applicable law, regulation, or institutional policy, including recording, wiretapping, eavesdropping, and privacy laws; (b) your use of the service; (c) your breach of these Terms; (d) any content, recordings, or other information you provide to ExamTeX; or (e) your infringement or misappropriation of any intellectual property or privacy rights of any person.

Subscriptions and Billing

ExamTeX offers a free tier and a paid Pro subscription. By subscribing to ExamTeX Pro, you agree to the following:

- Subscriptions are billed monthly or annually, depending on the plan you select
- All payments are processed by Lemon Squeezy, our merchant of record. Your payment is subject to Lemon Squeezy's Terms of Service
- Subscriptions renew automatically unless cancelled before the end of the current billing period
- You may cancel at any time through the subscription management portal. Access continues until the end of the paid period
- Refund requests are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error

Both free and Pro accounts are subject to the Fair Use policy described above. Specific feature availability for each tier is described on our Pricing page.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes.

Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time.

Changes to Terms

We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
